Acceptance of terms and conditions

The purpose of the present general conditions of sale is to regulate the relationship between ASINERIE DES VARENNES, a company registered in the LA ROCHELLE Trade and Companies Register under number 490 516 556, whose registered office is at DOMPIERRE SUR MER 17139, represented by MONSIEUR VAILLANT ANTOINE, the seller, and the buyer.

These general terms and conditions of sale, together with the price list, are expressly approved and accepted by the buyer, who declares and acknowledges full knowledge thereof, and hereby waives the right to invoke any contradictory documents, in particular his own general terms and conditions of purchase. The act of purchasing implies acceptance of these general terms and conditions of sale. The present conditions may be modified at any time and without prior notice.

I - Preamble

Le site marchand www.asinerie-varennes.fr (ci-après ” le Site “) est un site de commerce électronique accessible par le réseau Internet, ouvert à tout utilisateur de ce réseau. Il est édité par la société Asinerie des Varennes, société (ci-après dénommée l’Asinerie des Varennes), SARL au capital de 155 000 Euros, dont le siège social est 1 Fief des Varennes – 17139 Dompierre sur Mer, inscrite au Registre du Commerce et des Sociétés de La Rochelle sous le numéro : 492 011 796, numéro de Tva intracommunautaire FR 86399022458.

Le Site permet à l’Asinerie des Varennes de proposer à la vente la plupart de ses produits (ci-après ” les produits “) à des acheteurs non professionnels ayant la qualité de consommateur, étant âgés de plus de 18 ans et ayant la pleine capacité juridique (ci-après ” les Clients “).

Les présentes Conditions Générales de Vente (ci-après ” CGV “) régissent les relations entre la Société Asinerie des Varennes et les Clients souhaitant effectuer un achat ou naviguer sur le Site. Toute commande d’un produit proposé sur le Site implique l’adhésion pleine et entière du Client aux présentes CGV.

II - Tariffs

All prices are quoted in euros and include VAT, which is currently 19.6%. They are subject to change without notice.

III - Order processing

Once the order has been paid for, which can only be validated by full payment by credit card on the website or by post to the company's head office address (as the company never has access to confidential information relating to means of payment, the buyer's bank details will be requested for each new order), the order will be processed within 12 working days, plus 3 working days for delivery (tracked colissimo).

In all cases, an order is deemed to have been accepted when full and effective payment has been made.

IV - Means of payment

2. You can also pay by credit card.

For payment by credit card, we use the Stripe payment platform, which guarantees total security of your bank details.

V - Product quality

The colors of the products appearing on the site are not contractual. As appearance may vary from one screen to another, the company cannot fully guarantee the colors shown.

VI - Stock

In the event of a validated order being out of stock, the company will offer either another model or a refund.

VII - Delivery charges

Delivery costs are the responsibility of the buyer. They are an average, if they are exceeded the company Asinerie des Varennes will pay the excess in metropolitan France, the amount of delivery charges for all other destinations and any customs taxes will be communicated only on request and will depend on the weight of the package and the destination.

The company Asinerie des Varennes cannot be held responsible for a delay in delivery due to a failure of the carrier or major causes preventing delivery (strike, fire, blockage of road or rail networks, etc. ...).

At the time of ordering, the purchaser must carefully fill in the delivery address and indicate a telephone or mobile number.

Neither the company nor the carrier can be held responsible for the impossibility of delivery due to an imprecise address. In the event of force majeure, the initial delivery date will be extended by the duration of the force majeure incident.

VIII - Right of withdrawal

In accordance with the law, the buyer may return the product in its original packaging and in perfect condition for resale within a maximum of 14 days following receipt of the order, at his or her own expense. By way of exception, and in accordance with the provisions of Article L 121-20-2 of the French Consumer Code, "personalized" products cannot be refunded.

IX - Transfer of ownership - Transfer of risk

The transfer of ownership of the products to the buyer will only take place after payment of the price by the latter, regardless of the delivery date of the said products. Moreover, no product will be shipped before full and effective payment of the invoice. On the other hand, the transfer of risks, loss and deterioration of the products will take place upon delivery and receipt of the products by the purchaser.

X - Force majeure

The company Asinerie des Varennes cannot be held responsible for non-performance of the contract in the event of force majeure, external to the party, unforeseeable and irresistible.

XI - Intellectual property

All models, drawings, logos, images present on the site or appearing on the ordered products are protected by the right of intellectual and artistic property. They are the exclusive property of the asinerie and cannot be used without its agreement. Links to other sites without the agreement of the asinerie are forbidden, the presentation of products and graphics are protected and may not be copied. Any copy, any use, any parasitism is strictly forbidden and will be immediately sanctioned.

XII - Complaints

The customer must notify the company, by e-mail, on the day of delivery or at the latest on the first working day following delivery, of any claims for error (on the objects and not on the texts) or non-conformity of the products. Any claim made after this deadline will be rejected. Visible damage to the package on arrival will result in its rejection by the postal services.

XIII - Information and freedom

In accordance with the French Data Protection Act 78-17 of January 6, 1978, all customers have the right to access, rectify and object to data concerning them recorded on the site, as well as the legal notices.
